An assignment of auction rights is another way to acquire a property through enforcement proceedings initiated by a lender or real estate fund.
It allows a property to be acquired following enforcement by a fund or lender. Under this agreement, the fund awarded the property in a mortgage enforcement auction transfers its rights to another buyer before the award becomes final.
For this process to take place, the fund or lender must have initiated the enforcement proceedings and must be the successful bidder, whether as the highest or sole bidder at auction.
